In the fifth article in the Working with expert witnesses series, Richard Lodge a Partner at Stewarts, discusses his experience of working with Single Joint Experts. 

In her judgment on X and Y (Care Proceedings: Fact Finding: Death of a Child), the Judge was highly critical of the evidence and conduct during proceedings of one of the expert witnesses, a consultant neurosurgeon, Mr M. This judgment, which should be read alongside the earlier judgment, dealt with whether Mr M should be named within that published judgment.

This year’s Annual Conference discussed AI, independence, credibility, transparency and the changing expectations on expert witnesses.

This month on the Expert Matters Podcast, we take a look at the EWI Annual Conference which was held on 19 June. The Conference got off to a great start with a keynote speech on AI & the Expert Witness by Sir Geoffrey Vos, the Master of the Rolls, and carried on with great speakers and panels. Join us on a trip down memory lane as we relive our key highlights from the event. 

This was a fact finding hearing into the death of a young child. The Judge found that the neurologist expert witness failed to discharge his duties as an expert witness to the family court.

The Family Procedure (Amendment) Rules 2026 amend the Family Procedure Rules 2010 to restrict unregulated experts from acting as expert witnesses in Family Law Children Proceedings. The amendments come into force on 20 July 2026.

At a recent Frontier Economics Litigation event, the President of the Competition Appeal Tribunal, The Honourable Mrs Justice Bacon, warned that advocate economists, or economists who ignore obvious analytical points adverse to their client, were not helpful to the Tribunal and self-defeating for the expert.

The Claimant suffered serious injuries in a road traffic accident after the Defendant, who was driving out of a side road, collided with the Claimant’s motorbike. Despite being aware of surveillance evidence before preparing his last report, the Claimant’s orthopaedic expert did not reveal his true opinions on the Claimant’s malingering until cross-examination.

The EWI has just published its new guide to Becoming and Expert Witness. Written by EWI Member Paul Beckett, the guide is aimed at those who are considering undertaking, or who have just begun undertaking, Expert Witness work.

The parties disagreed on the extent of the repairs required to the joists, and the manner in which the repairs should be effected, following the collapse of part of the ceiling in a building owned by the Claimant and partly leased by the Defendant. The Judge found that the Defendant’s expert’s failure to engage with all the available evidence and to seek to undertake a fuller examination of the joists meant that his evidence did not fully address the issues before the court.
