They represent the Institute’s view of good practice in a particular area, and members are not obliged to follow them. They do not constitute legal or professional advice and should not be relied upon as a substitute for it. Update on unregulated experts in children proceedings

bySean Mosby

The Ministry of Justice has told the Family Procedure Rule Committee (''Committee') that the Ministry intends to draft amendments to the Family Procedure Rules regulating experts appointed by the court in both public and private law children proceedings (FPRC June minutes, paragraphs 7.1-7.3). This follows a commitment by a Minister of Justice in a House of Lords debate to a solution to unregulated experts in children proceedings. The Ministry intends to produce a final draft by the end of 2024 with the Committee planning a further consultation before a final Practice Direction or any proposed amendment is approved.

The EWI will be following developments on this amendment and participate in any consultation.
