Guidance on the Remuneration of Expert Witnesses in Crime Cases

by Sean Mosby

The Legal Aid Agency ('LAA') has issued Guidance on the Remuneration of Expert Witnesses in Crime Cases. The LAA previously applied the Guidance on the Remuneration of Expert Witnesses in Family Cases to these types of cases. The new Guidance includes details on:

  • How the rates work,
  • London and non-London experts,
  • The LAA's apporach to assessing expert costs,
  • Applications for Prior Authority,
  • Types of Expert,
  • Associated Expert Costs, and
  • Summary of Expert Witness Fees in Legal Aid Regulations.

We recommend that members who act in criminal cases funded by legal aid familiarise themselves with the requirements of the new Guidance.
