Competition Appeal Tribunal Practice Direction on Expert Evidence

Competition Appeal Tribunal Practice Direction on Expert Evidence

by Sean Mosby

The Competition Appeal Tribunal has published a Practice Direction on expert evidence. The Practice Direction sets out the principles applicable to expert evidence in the Tribunal, including general principles applicable to the evidence of any expert, as well as certain specific principles applicable to economic evidence.

While not bound by the Civil Procedure Rules, the Tribunal also notes that it will take into account and will generally apply (in so far as relevant) the principles set out int CPR PD 35.

Experts who act in cases before the Competition Appeal Tribunal should ensure that they are familiar with the new Practice Direction and be aware that the Tribunal will also generally apply the requirements set out in CPR PD35. Links to the Tribunal's Rules, Practice Directions and Guidance can be found below and in the EWI Knowledge Hub
