Commentary

It appears that in this case an expert recommended the appointment of an intermediary without understanding the role of an intermediary. The court did accommodate proper breaks and ensured clear explanations as to the charges faced.

Learning points:

  • The role of an intermediary is to help with communication.

  • An expert who considers that a defendant might need an intermediary should advise the instruction of an intermediary with a view to identifying any communication difficulties with which they might assist and give their reasons.

  • Clear explanations as to the charges faced by a defendant are in the first instance a matter for the defendant’s lawyers and not for an intermediary.
