Summary

The case focussed on the validity of a will and codicil made by a wealthy lady, Mrs MacDougall, as well as a number of substantial gifts and transactions made in the years before her death. Both parties called experts in Old Age Psychiatry to provide evidence on issues of testamentary capacity, as well as Mrs MacDougall’s vulnerability to undue influence.

Learning points

  • When drafting your report, keep in mind what material might assist the court. For example, in this case the judge noted that a summary of the material medical records (and key events) had been particualrly helpful.

  • The court is likely to appreciate the efforts of experts who work effectively together to establish the points of agreement and disagreement between them.
