Commentary

This is a fascinating case in terms of the expert’s qualifications, training and experience. As a result of the expert not setting these out in the report, and for other reasons, the judge could attach little or no weight to the expert’s opinions. If the judge had made a brief internet search, and assuming that there are not two persons with Dr Q’s unusual name, this is what the judge could have established as to Dr Q’s qualifications, training and experience for a case where the married appellants were relying on the wife’s dementia, the effects of a stroke, balance and mobility difficulties, hearing loss and osteoarthritis, and the husband’s mobility difficulties arising from a previous stroke, chronic leg pain, high blood pressure, high cholesterol and chronic kidney disease for their Article 3 ECHR  claim that removal to Bangladesh would expose them to a real risk of a serious deterioration in health because of the absence of, or inability to access, appropriate medical treatment and care.

Dr Q has a BA (Hons) Physical Education and Psychology, (Research Topic: The Catastrophe Model), an MPhil Sports Psychology (Research Topic: The Anxiety Performance Relationship, A Match Analysis Approach) University of Wales (Bangor) and a Ph.D. Sports Psychology (Research Topic: Towards Optimal performance), Sheffield Hallam University. Dr Q is registered with the HCPC as a Sports and Exercise Psychologist and with the BPS as a Chartered Sports Psychologist. He has with significant experience working with elite athletes in high performance environments; expert knowledge of utilizing psychology interventions to optimize performance and human potential; and experience in management, inspirational leadership and delivering innovative operational development solutions. He was Sport Psychologist on the PGA European Golf Tour and as a consultant psychologist he has extensive experience of individual needs analysis and the delivery of high performance services to some of the world’s top golfers. He has worked alongside the coaches and managers of professional sports creating world-class high performance programs that led to major victories at the Ryder Cup, British Open Golf Championships, USA Open Golf Championships and World Golf Championships. He is Reader at Hartpury University where he delivers lectures and academic solutions at level 4, 5, 6, 7.  The judge had no information as to any academic papers which were peer reviewed or information as to books or articles he had written. He has more than twenty papers published in mainly sports psychology journals. He has written or co-authored four books:
